As someone who has worked at AOL and the largest ISP in Belgium, and advocated policies like this myself, I would agree. But I wouldn't advertise anywhere that people can pay to opt out of the transparent proxy. I would instead require that they contact me on their own initiative.

Once they've done that and I've got their signature on a contract that allows me to wield terrible punishment upon them if they violate it, then I'd be willing to move them to another network where they would be allowed unfettered access.

Of course, they'd pay for that access, and it would be a different type of account.
